Resolutions passed at the 34th Annual Diocesan Convention

Resolution 01-07 was passed at the 33rd Annual Diocesan Convention in February 2007. Because it is a requested change to the Constitution, it requires a second reading and vote at this 34th Annual Convention.

 

RESOLUTION 01-07

THE EPISCOPAL DIOCESE OF SAN DIEGO

33rd ANNUAL DIOCESAN CONVENTION, February 9 & 10, 2007

Title: Revisions to Constitution

WHEREAS, the language of the Canons of The Episcopal Church and of this Diocese has been modified over time, and the term “Minister” has been replaced with Priest, Presbyter, Rector, Vicar, Deacon or Member of the Clergy, as the context requires; and

WHEREAS, the Canons of the National Church were revised to change the designation of bishops to place the adjective describing the order of bishop after the word “Bishop;” and

WHEREAS, in order to clarify the distinction between the Vestry of a Parish and that of a Mission, it is advisable to use the traditional denomination of “Bishop’s Committee” when referring to the governing board of a Mission.

RESOLVED, THEREFORE, that the following provisions of the Constitution be amended to change the word “Minister” to “Member of the Clergy” or such other terms as the context requires, and to change the terms “Suffragan Bishop” to “Bishop Suffragan,” and “Diocesan Bishop” to “Bishop Diocesan,” in conformity to the Constitution and Canons of the National Church:

Article IV, Section 4:

Section 4. There may beBishops Suffragan. There may beBishops Suffragan as provided in the Constitution and Canons of The Episcopal Church, one of whom in the order of seniority of consecration unless otherwise determined by the Standing Committee, shall in the event of the death of the Bishop or in the event of and for the period of absence or indisposition of the Bishop and of the Bishop Coadjutor, act as the Ecclesiastical Authority.

Article IV, Section 7:

Section 7. Controversies. Irreconcilable controversies between the Priests-in-Charge, Rectors or Vicars of two or more congregations, or between a congregation or its Vestry and itsPriest-in-Charge, Rector or Vicar, or between persons adversely claiming to be Members of the Vestry of a congregation, shall be referred to the Ecclesiastical Authority for determination.

Article VI, Section 1:

Section 1. Members of Convention. The Convention of the Diocese shall be composed of the Bishop, the Bishop Coadjutor (if there be one), theBishop or Bishops Suffragan (if there be such), all Priests and Deacons canonically resident in the Diocese and of Lay Delegates from all congregations. The right of Priests and Deacons to vote and the mode of election of Lay Delegates shall be prescribed by Canons.

Article VII, Section 2:

Section 2. In Case of the Absence of the Bishop. In the absence of the Bishop, the Bishop Coadjutor, if there be one, shall preside. In case the Bishop Coadjutor, if there be one, shall be absent or incapable of acting, the convention shall elect the Bishop Suffragan, if there be such (or if there be more than one, one of them as determined by the Ecclesiastical Authority), or a Priest of the Convention, to act as President Pro Tempore of that Convention.

Article XI, Section 3:

Section 3. To Act in Absence of Bishops. When the Diocese is without a Bishop or in the absence or indisposition of the Bishop and of the Bishop Coadjutor and of theBishop Suffragan, if there be such, the Standing Committee shall become the Ecclesiastical Authority of the Diocese.

Article XIV, Section 1:

Section 1. Parish May be Dissolved after Three Years Inactivity. Whenever any Parish in union with Convention shall neglect for three successive years to make an Annual Parochial Report to the same, or during like period shall neither have employed a Priest as itsRector, nor requested of the Ecclesiastical Authority the services of a Priest, …

 

EXPLANATION OF RESOLUTION:

These revisions are intended to (a) harmonize the title of Bishops Suffragan with the change made to the National Canons several years ago, and (b) eliminate use of the term “Minister”, changing that language to the appropriate language based on the circumstances.

Title I, Canon 10.01

10.01 On Dispatch of Business. The Committee on Dispatch of Business shall be members of Convention. It shall be the duty of this Committee to prepare, prior to the Annual Convention, the order of business to be presented and considered thereat and to report the same to Convention for consideration.

Title I, Canon 10.02

10.02 On Rules of Order. The Committee on Rules of Order shall consist of one or more Member of the Clergy and one or more Lay Persons who shall be members of Convention. It shall be the duty of this Committee to consider all matters pertaining to Rules of Order of the Convention and questions arising thereunder and to report thereon to Convention. In the Bishop’s discretion, the Committee on Canons may fulfill the duties of the Committee on Rules of Order.

Title I, Canon 10.04

10.04 DELETED

Title I, Canon 10.05

10.05 On Admission of Parishes and Missions. The Committee on Admission of Parishes and Missions shall consist of at least one Member of the Clergy and at least one Lay Persons who shall be members of Convention. It shall be the duty of this Committee to consider all matters pertaining to the admission of Parishes and Missions into union with the Convention and to report its recommendations to the Convention.

Title I, Canon 10.06

10.06 Resolutions. The Committee on Resolutions shall consist of Members of the Clergy and Lay Persons who shall be members of Convention. It shall be the duty of this Committee to consider all resolutions that shall be referred to it by the Convention and to make its report and Recommendations thereon to the Convention.

Title I, Canon 10.08

10.08 On Canons. The Committee on Canons shall consist of Members of the Clergy and Lay Persons, of whom one shall be the Chancellor, ex officio. The Bishop shall appoint one of said members as Chair. It shall be the duty of this Committee to consider prior to the Annual Convention all proposed additions to and alterations and amendments of the Constitution and Canons of this Diocese, which must be submitted to said committee at least 90 days prior to Convention, and to report its recommendations to the Convention.

Title I, Canon 10.09

10.09 DELETED

Title I, Canon 10.10

10.10 On Financial Review. The Committee on Financial Review shall consist of members of the Clergy and Lay Persons. At the request of any parish or mission which has not met, or anticipates not meeting, its Minimum Diocesan Contribution (as defined in Title IV, Canon 2.03), this Committee shall meet and review the financial condition of the congregation concerned, to determine whether the congregation should be entitled to voice and vote at the next Convention, notwithstanding the congregation's failure to meet the Minimum Diocesan Contribution. The Committee shall meet and report in sufficient time to forward its findings to the Secretary at least one week prior to the Convention.

Title I, Canon 10.12

10.12 May be Appointed in Advance – Terms of Committee Membership. Except as otherwise provided herein, the Bishop, or in the Bishop’s absence, the ecclesiastical Authority, shall make the appointments to the foregoing Committees annually, to serve at the pleasure of the Bishop. Any member of a Committee who has completed a term may be reappointed. The time of making such appointments shall be at the discretion of the Ecclesiastical Authority.

Title: Proposed Revisions to Title II, Canon 6

Title II, Canon 6.00

6.00 Duties, Election and Organization. At an Annual Meeting to be called upon reasonable notice as soon after January 1st of each year as is practical, each congregation shall elect to manage its temporalities a Vestry or Bishop’s Committee (referred to herein as “Vestry”) composed of persons who are at least 18 years of age and who are qualified electors of the congregation which elects them, the number to be determined by its Bylaws or Articles of Incorporation. The Rector of a Parish or the Vicar of a Mission shall be a member of the Vestry. The Senior and Junior Wardens shall always be communicants in good standing. In Parishes, the Senior Warden shall be appointed from the Vestry by the Rector. In Missions the Senior Warden shall be appointed by the Bishop. In all cases, the Junior Warden shall be elected from the Vestry by the Vestry. When a rectorship is vacant, the Parish Vestry shall elect the Senior and Junior Wardens from the Vestry. The Wardens may be alternately termed “Rector’s Warden” or Bishop’s Warden” and the “People’s Warden.”

Title II, Canon 6.04

6.04 Member of the Vestry May Preside. The Rector, Vicar, or Priest-in-Charge, when present at a Vestry meeting shall preside personally, but may delegate presiding to some other member of the Vestry.

A COVENANT RELATIONSHIP BETWEEN THE COMPANION DIOCESES OF THE EPISCOPAL DIOCESE OF SAN DIEGO AND THE ANGLICAN EPISCOPAL DIOCESE

OF EL SALVADOR

In the name of God: Creator, Liberator and Advocate:

Be it resolved, that the laity, clergy and bishop of the Episcopal Diocese of San Diego, California, responding to God’s grace, enter this day into a four year covenant relationship as a companion diocese with the laity, clergy and bishop of the Anglican Episcopal Diocese of El Salvador.

Be it resolved, that we promise to walk and to work together on our faith journey in the same mission of bringing the Good News of God’s unconditional love through Jesus Christ for every person. We resolve to develop relationships of respect, mutuality and interdependence with each other.

Be it resolved, that we promise to hold each other up in prayer. We will name each other in our diocesan prayer cycle, in our congregational Prayers of the People and in our schools and institutions.

Be it resolved, that we promise to be there for each other as followers of Jesus on pilgrimage. We will seek ways of sharing personnel and material resources.

Be it resolved, that in the two dioceses, we recognize similar congregational organizations such as parishes, missions, schools, and university ministries within which these counterparts can establish relationships of support, sharing and financial assistance.

Be it resolved, that congregational development in the two dioceses could take the form of Cursillo, on going education of lay leaders and clergy, clergy exchanges and other expressions which the Spirit will make known.

Be it resolved, that we also foresee collaborative efforts with the Fundación Cristosal and other Episcopal dioceses who also have a Companion diocese relationship with the Anglican Episcopal Diocese of El Salvador.

Be it further resolved, that trusting in God’s providence and in the good will of the people of our respective dioceses, we sign our names to this document during thediocesan convention of the Episcopal Diocese of San Diego on the 9th day of February 2008 and look forward to a similar signing during the diocesan convention of the Anglican Episcopal Diocese of El Salvador in May 2008

Pursuant to the February 2007 San Diego Diocesan Convention Resolution 13-07, the Task Force for Implementing the Companion Relationship with the Diocese of El Salvador presents this covenant text for 2008 Diocesan Convention's approval and for the two bishops’ signatures.

 

RESOLUTION 08-06

Title: Global Reconciliation and 0.7% giving for international development

1. RESOLVED, that the 34h convention of the Episcopal Diocese of San Diego meeting at St. Margaret’s Palm Desert, February 8-9, 2008 affirm and embrace the achievement of the Millennium Development Goals (MDGs) that pledge to:
1) eradicate extreme poverty and hunger
2) achieve universal primary education
3) promote gender equality and empower women
4) reduce child mortality
5) improve maternal health
6) combat HIV/AIDS, malaria and other diseases
7) ensure environmental stability, and
8) develop a global partnership for development; and be it further

2. RESOLVED, that this Diocese of San Diego, as a part of fulfilling its mission to "reconcile all people to God and each other in Christ," and in accordance with the challenge set forth by the 73rd, 74th and 75th General Conventions (2000, 2003, and 2006) and the 1998 Lambeth Conference:
1) set a goal to begin in 2009 to give a minimum of 0.7% of the annual diocesan budget to fund     ministries that contribute to the realization of the Millennium Development Goals

2) beginning with 2008, encourages the Bishop of the diocese of San Diego to dedicate a minimum      of 0.7% of the income from budget to fund international development programs

3) challenges all communities of faith in the Diocese of San Diego to give a minimum of 0.7% of their           budgets to ministries that contribute to the realization of the Millennium Development Goals

4) challenges all Episcopalians in the Diocese of San Diego to give a minimum of 0.7% of their income to     ministries that contribute to the realization of the Millennium Development Goals, and be it further

3. RESOLVED, that the Bishop of San Diego charge the diocesan Commission on Peace and Justice, whose charge will include
            1) making informed recommendations to the Bishop and Diocesan Council about the disbursement of the     0.7% funds.
            2) building an accessible database of and facilitating connections among all ministries in the diocese           engaged in world mission and international development and to recommend to the Diocesan Council that           the cost of this database be included in the 2009 Program Budget
            3) providing opportunities for education about and engagement with works of global reconciliation -    including using our connection in the Anglican communion to build relationships with people and          communities in the developing world, and be it further

4. RESOLVED, that all Episcopalians in the Diocese of San Diego are encouraged to contact their elected representatives urging them to support the United States' government's fulfillment of its commitment to funding international development aid at 0.7% of U.S GNP. and that the Secretary of Convention shall write the President of the United States and each of the members of the U.S. Congress representing California, that the Diocese of San Diego, meeting in Convention, urges them to support the United States' government's fulfillment of its commitment to funding international development aid at 0.7% of U.S GNP.

 

RATIONALE
Everyday more than 60,000 people worldwide die needlessly because food and basic health care is not available to them. Of those, 30,000 are children. That’s one child dying needlessly every three seconds. Four children have died preventable deaths in the time it took you to read this paragraph.

Our humanity tells us it shouldn’t be this way. An amazing coalition of development economists, world leaders, teachers, businesspeople and many, many others, tell us it doesn’t have to be this way. The Gospel tells us that we are the ones who need to make sure it isn’t this way any longer.

In September, 2000, all the nations of the world pledged support to the Millennium Development Goals, a mutually agreed upon structure for them to join together and practically address the eight biggest threats to human security in the world today. The U.S. government fails to meet a 30-year-old international goal of giving 0.7% of GNP to international development assistance and is last in giving among the 20 richest nations (at 0.14% of GNP … and lest we think personal and corporate philanthropy makes up the difference, that figure only rises to 0.19% when you factor in non-governmental U.S. donations. The Episcopal Church can lead by example in contributing 0.7% of annual budgets to international relief and development, as directed by Lambeth 1998 and General Convention 2000 and 2003 - all of which challenged the church to fund international development at 0.7%.

It is especially appropriate at this time, when both our nation and our church are experiencing strained relationships with our sisters and brothers around the globe, that we commit in a tangible way to works of love, mercy and reconciliation on a global scale.

Title: Resolution Regarding The Episcopal Church and The Religious Coalition for Reproductive Choice

Whereas the Executive Council of the Episcopal Church by official action on January 12, 2006, formally affirmed the affiliation of the Episcopal Church in the United States with the “Religious Coalition for Reproductive Choice,” formerly known as the “Religious Coalition for Abortion Rights,” which is an organization which actively promotes abortion on demand for any reason for all nine months of pregnancy and

Whereas we believe the goals and principles of the Religious Coalition for Reproductive Choice (RCRC) as stated on their Website conflict with biblical theology related to the sanctity of human life, and

Whereas the 75th General Convention of 2006 was denied the opportunity to make any vote concerning the continued membership of The Episcopal Church in the RCRC

Therefore be it Resolved that the 2008 Convention of the Diocese of San Diego (34th Annual Diocesan Convention) request that the 76th General Convention meeting in Anaheim, California, end the officially sanctioned affiliation of the Episcopal Church with the Religious Coalition for Reproductive Choice.

 

EXPLANATION OF RESOLUTION:

The Episcopal Church has a clear position on abortion articulated in General Convention resolutions in 1988, 1994, and 1997. However the decision to officially sanction affiliation with the Religious Coalition for Reproductive Choice was made by the Executive Council. The Episcopal Church is the only denomination so affiliated. This resolution would allow the General Convention in 2009 to study, discuss, debate, and decide if our affiliation is appropriate.

 

RESOLUTION 08-08

Title: Youth Representation

WHEREAS, The Body of Christ includes members of all ages and life stages, and,

WHEREAS, Jesus said, “Let the little children come to me,” and,

WHEREAS, the current voting age of the Diocese prohibits all her members from directly participating in the decisions of The Body, and,

WHEREAS, this body celebrates the presence, in seat and voice, of youth members of our diocese, and,

WHEREAS, Resolution 92-11 of the 18th Annual Convention of the Episcopal Diocese of San Diego recognizes ‘that the youth of our diocese have an increasingly powerful witness and are committed to the well being of the Church,

We strongly recommend that this 18th Diocesan Convention affirm the value of their ministries among us by strongly suggesting that congregations prayerfully consider youth members of their congregations to be representatives in their voting delegation’, and,

WHEREAS, decisions made by this body will shape the future of those in our Diocese too young to vote,

THEREFORE, BE IT RESOLVED, that a committee be formed to research the legality of youth voting in the Episcopal Diocese of San Diego under laws dictating corporate membership within the State of California and to bring those findings for consideration at the 35th Annual Convention of the Episcopal Diocese of San Diego.

 

EXPLANATION OF RESOLUTION:

Sixteen years ago a resolution called for youth representation in the decision making process of our diocese by encouraging congregations to raise up youth members of their community to serve as delegates to Diocesan Convention. Although this has been mildly successful, a committee is requested be formed to research and report the reality of lowering of voting age at Diocesan Convention, to more fully include teens, of a decided age, to serve as full delegates of their parish or mission with seat, voice, and vote.

Be It Resolved that the Bishop of the Diocese of San Diego is urged to appoint a theologically diverse Task Force of clergy and lay people reflective of the Diocese, to study Holiness in Relationships and Blessings in Churches of this Diocese from the perspectives of holy scripture, church history and tradition; practical, pastoral and sacramental theology; and the movement of the Holy Spirit; and then prepare an academic paper on the subject to be presented to the 2009 Convention of the Diocese of San Diego, with additional recommendations as that Task Force might deem appropriate.

Be it Further Resolved, in advance of the presentation at convention, workshops be promoted throughout the diocese to engage congregations in this work and mission.

 

EXPLANATION OF RESOLUTION:

Whereas much of the conflict in the Episcopal Church concerns the issue of holiness in relationships, and

Whereas the Order for Marriage found in the Book of Common Prayer states that Christian marriage is between a man and a woman, and

Whereas, there are persons in the Episcopal Church (gay and lesbian, seniors and others constrained by financial concerns) who are in committed, monogamous relationships who wish to have their relationships blessed in the church by a clergy person, and

Whereas there are persons in the church, who because of their understanding of scripture and what constitutes a faithful life are opposed to such blessings occurring in the church, and

Whereas liturgical practices surrounding the blessing of unions are not consistent throughout the greater church, and

Whereas the House of Bishops in their September 25, 2007 response to “questions and concerns raised by our Anglican Communion partners,” noted that the 1998 Lambeth Conference called on provinces of the Anglican Communion to engage in a “listening process” designed to bring all Anglicans fully into the Church’s conversation about human sexuality and holy relationships, and

Whereas engaging in such a listening process is a fundamental step before engaging in any action on the matter.

 

 

RESOLUTION 08-10

Title: The Naming of the St. Luke’s Refugee Network as an Institution of the Diocese

WHEREAS the St. Luke’s Refugee Network has been a ministry of St. Luke’s Church since 1995 when it began as a refugee resettlement program primarily focused on the resettlement of refugees from the Sudan; and

WHEREAS this ministry has been supported by members of congregations throughout the Diocese and received funding through grants from the United Thank Offering, Trinity Church, Wall Street, Episcopal Relief and Development and the Eli Lilly Foundation; and

WHEREAS throughout the years of the development of this ministry, it has grown to a budget of $191, 184

and extended its program to refugees of other countries throughout the world; and

WHEREAS this ministry has been duly incorporated and awaits its designation as a 501© 3 nonprofit corporation in the State of California and has followed the appropriate steps to become an Institution of the Diocese under Title III, Canon 5;

RESOLVED that this 34th Convention of the Diocese of San Diego name the St. Luke’s Refugee Network as an Institution of the Diocese of San Diego with all the rights, privileges and responsibilities as are appropriate under the authority of the Constitution and Canons of the Diocese of San Diego.

 

EXPLANATION OF RESOLUTION:

The Board of the St. Luke's Refugee Network recently passed a motion to submit a Resolution to become an Institution of the Episcopal Diocese of San Diego. The Vestry of St. Luke's Church has voted to accept this action. An agreement has been signed by the Network Board and by the St. Luke's Vestry, concerning items that have been defined as the property of the Board and not of the Church. The Network is now registered as a separate Corporation of the State of California. Application has been made to the Federal Government for independent status as a 501 c 3 tax-free status. The St. Luke's Refugee Network has had a 12-year history as an Outreach Mission of St. Luke's Church, beginning under the name of The International Friendship Committee. The Network has now grown financially and in service area to the point that Diocesan status is appropriate for the Mission it carries out.

Be it Resolved that the 34th annual Convention of the Diocese of San Diego express its deep concern about the ongoing political violence in Kenya following December’s disputed elections and urges all parties to the violence to stand down and seek peaceful means to achieve a mutually agreeable solution.

Be it further resolved that this Convention expresses its support for Bishop Simon Oketch and the leadership of the Anglican Church of Kenya in their efforts to stop the violence.

Be it further resolved that this Convention pledges to persevere in its mission work in Kenya through ongoing pastoral, fiscal and volunteer support for the work of Gerry and Nancy Hardison as missionaries of the Diocese of San Diego.

 

EXPLANATION OF RESOLUTION:

For several years the Diocese of San Diego has sponsored, with All Souls’ Episcopal Church, the medical, educational, relief and economic development ministries of Nancy and Gerry Hardison in the Diocese of Maseno, North of the Anglican Church of Kenya.The current political turmoil has led to a breakdown in civil order threatening the safety of the Hardisons and all those whom they have served these past years.

This resolution is therefore at least one tool in the efforts of the Hardisons to persevere and to encourage those among whom they minister and for Bishop Oketch to know that we will not abandon our work in his Diocese.
